Terms and Conditions

DEFINITIONS :
In the terms and conditions set out in this document, the following terms shall, unless contrary
to the context have the meaning specified.
“You” means the person/s in whose name and/or whose behalf the booking is made or
Alternatively the reference may be made in the third person “Tour
Participants/they/Client/them/his/her”
“We / Company” means Curtain Call Adventures”

“Website means https://curtaincalladventures.com/ “

“Brochure” means to print a brochure, Website, Itinerary, leaf-lets, booklet, and Tour cost”

“Suppliers / Providers” means suppliers/providers of the any infrastructural facility and shall
include hotel management, airlines, caterers, restaurants, places of entertainment, shipping
company, railway, ferry, cruise, coach who are to provide the services to the client”

“Force majeure” means include circumstances beyond our control like acts of god/nature,
major road works, traffic congestions, weather condition, fairs, festivals, sports events,
political/religious gatherings, strikes, change of management/closure hotels, restaurants, over
booking of hotels/flights, delay/cancellation rerouting of flights or railway, closure/restricted entry
at a place of sightseeing etc.,”

“Jurisdiction means geographical area over which a Court or Government Body has the Power
or right to exercise the authority, parties hereto agree to confer exclusive jurisdiction to
Guwahati/ Forums”.

“Tour Cost means the tour cost mentioned in the Price Grid/brochures, online and other
payments such as taxes, surcharges etc., payable by the client to the company”

Agency: We act as a travel agent only. We sell various travel related products on behalf of
numerous suppliers / third party providers such as transport, accommodation and other
wholesale service providers, airline, coach, railway, cruise line operators. If for any reason, any
suppliers/travel service providers is unable to provide for which you are contracted, your remedy
lies against the said suppliers / service providers and not with us.

Brochure / Website information: We take reasonable care in preparing the brochure, Tour
cost, Webpages and other documents and in describing the services therein. The information
contained in our website is correct to the best of our belief, but we accept no liability for any
inaccuracy contained therein. The products and services displayed may have changed. We
reserve the right to alter amend/change or modify the itineraries before the departure, or during
the tour. Such changes may be necessitated due to factors beyond our control such as force
majeure. Change in itinerary may also be required or necessitated on account of
actions/inactions/defaults or condition of tour participants in the group. We will make reasonable
efforts to keep the overall packages unchanged and in the event of any significant change the
same will be informed in advance, however we shall not be liable to refund any amount or pay
any compensation/damages on account of any changes in the itinerary.

Contract subject to signature and payments: Please note if there is no contract between us
and you and until the booking documents are signed and received by the us. The full payment
of the Tour cost must be received in accordance with the prescribed payment schedule. If not
paid in accordance with the payment Schedule the company reserves the right to cancel the
booking with consequent forfeiture of booking amount and apply scale of cancellation charges
as mentioned in the brochure

Conditions of other third party operators: In the event of your booking through us a
tour/travel service of any third party operators, like Insight Vacations, Star Cruise etc., the terms
and conditions of such third party operators including their payment
schedule/cancellation/refund etc., shall be applicable to you in addition to these terms and
conditions. We shall not be liable or responsible for the non-performance of the various third
party service providers under no circumstances we will be liable to refund or compensate for
non-performance of other third party providers.
We reserve the right to amend the prices published in the brochure and on the website and to
adjust our charges based on various factors including currency fluctuation, fuel price rise, travel
arrangements, special/high season charge levied by the supplier, hike in any government taxes
or any taxes before the date of departure

Health and Travel Insurance:- The client should have his/her own health and travel insurance.
In case the client decides to obtain travel insurance from the Company, it should be noted that
we act as a mere facilitator and that the contract of travel insurance is directly between the
client and insurance Company. Client should check all details of the travel insurance in case of
any error or lapse, report the same shall be communicated to the Insurer directly and get the
same rectified by them, as we would not be responsible for the same. All clients not possessing
valid travel insurance are travelling at their own risk. The insurance must include adequate
cancellation insurance to the value of your holiday, emergency evacuation and repatriation cost
in respect of all your activities.

Liability: We always do our best to make sure your holiday arrangements are satisfactory.
However, we cannot accept any liability of whatever nature, whether in contract, tort or
otherwise for the acts/omissions or default, whether negligent or otherwise, of the service
providers, over whom we have not direct control. Under circumstances were liability cannot be
excluded, such liability is limited to 10% of the entire bill. Further We do not accept any liability
in contract, tort or otherwise for any injury, damage, loss, delay, additional expenses or
inconvenience caused directly or indirectly by force majeure or any other event which is beyond
our control or which is not preventable by reasonably diligence on our part.

Governing Law: If any dispute arises in relation to the agreement between you and us as
constituted by this terms and conditions or otherwise, the Laws of India will apply. You
irrevocably and un-conditionally submit to the exclusive jurisdiction of the Courts in Guwahati.
